44-1218. Fraudulent or mock auction;
classification; forfeiture of license and disqualification of
auctioneer


A. A person who obtains money or property from another, or obtains the signature of
another to a written instrument, the false making of which would be forgery, by means of
a false or fraudulent sale of property or pretended property by auction, or by any
practice known as a mock auction, is guilty of a class 6 felony.


B. A person convicted of a violation of subsection A of this section shall forfeit
his license as auctioneer, and shall be forever disqualified from receiving a license to
act as auctioneer.
