44-1409. Judgment as prima facie
evidence
A final judgment or decree determining that a person has violated this article in an
action brought by the state under section 44-1407 or 44-1408, subsection A, other than a
consent judgment or decree entered before any testimony has been taken, is prima facie
evidence against such person in any other action against him under section 44-1408 as to
all matters with respect to which the judgment or decree would be an estoppel between the
parties thereto. This section does not affect the application of collateral estoppel or
issue preclusion.
