44-6904. Notification of rights


A. A performing rights society shall not enter into or offer to enter into a
contract for the payment of royalties by a proprietor unless at the time of the offer or
any time after the offer, but not later than seventy-two hours before the execution of
the contract, the performing rights society provides to the proprietor the following
items in writing:


1. A schedule of the rates and terms of the royalties under the contract, including
any sliding scale, discount or reduction in fee on any basis for which the proprietor may
be eligible and any scheduled increase or decrease in fees during the term of the
contract.


2. A notice that, on request by a proprietor and before entering into a contract
with that proprietor, the performing rights society shall provide a schedule of the rates
and terms of royalties under other contracts executed by the performing rights society
and proprietors of comparable businesses in the same county.


3. A copy of section 44-6903 or a statement of its provisions.


4. A notice that the proprietor is entitled to any information that the proprietor
is allowed to receive under this article and that failure by the performing rights
society to provide that information is a violation of this article.


B. In addition to the requirements prescribed in subsection A of this section, on
request by the proprietor, the performing rights society shall allow the proprietor to
review at the proprietor's premises the current available list of the members or
affiliates represented by the performing rights society.
