45-1445. Flood control assistance fund; limit
of financial assistance


A. A flood control assistance fund is established. All or part of an appropriation
to the fund may be allocated for a specific flood control project defined by section
45-1441, paragraph 3, subdivision (a). All payments for flood control assistance under
this article shall be made from the fund. The monies in the fund are exempt from section
35-190, relating to lapsing of appropriations.


B. The state may contribute funds not to exceed one-half of the non-federally
supported cost solely for lands, easements and rights-of-way necessary in connection with
the construction of any federal or federally assisted flood control project recommended
by the director, subject to appropriation of monies by the legislature.
