45-176. Transfer of water rights; water rights
settlement; limitation; required consent

A water right may be severed from the land to which it is appurtenant or from the
site of its use if for other than irrigation purposes without losing priority to the
water right established, with the consent and approval of the owner of the right, and
transferred to an Indian tribe, or the United States in trust for the benefit of the
Indian tribe, with a congressionally approved tribal water rights settlement agreement
for lands within the little Colorado river basin for vegetative restoration use including
wildlife. The rights severed and transferred pursuant to this section shall not, in
total, exceed three thousand six hundred acre feet. The severance and transfer is subject
to approval by a court of competent jurisdiction, or if none, by the director pursuant to
section 45-172.
