45-2625. Replenishment related to
transportation of underground water or stored water away from an
eastern protection zone or a western protection zone for
nonirrigation use
If a person transporting underground water or stored water away from an eastern
protection zone or a western protection zone for a nonirrigation use elects to replenish
the underground water or stored water so that the transportation qualifies as an
authorized transportation under section 45-2611, subsection B, paragraph 2, the person
shall replenish the water by performing one or both of the following replenishment
activities in an amount equivalent to the amount of water transported:
1. Pay the authority an amount of money sufficient to allow the authority to credit
the community's account by delivering water to the community in accordance with the
delivery procedures set forth in the intergovernmental agreement described in section
45-2624, subsection D. Any credits registered to the community's account under this
paragraph shall not be used to meet the authority's requirement to deliver water to the
community under section 45-2624, subsection B or C.
2. Replenish water in any manner that is approved in writing by the community and
that is not prohibited under this title.
