45-263. State law applicable; public trust
inapplicable


A. State law, including all defenses available under state law, applies to the
adjudication of all water rights initiated or perfected pursuant to state law.


B. The public trust is not an element of a water right in an adjudication
proceeding held pursuant to this article. In adjudicating the attributes of water rights
pursuant to this article, the court shall not make a determination as to whether public
trust values are associated with any or all of the river system or source.
