45-416. Limitation on number of irrigated
acres


A. If the director initiates the procedure for designating a subsequent active
management area or the board of supervisors calls an election to establish an active
management area, an irrigation user may irrigate within the proposed active management
area only acres of land which were legally irrigated at any time during the five years
preceding the date of the notice of the initiation of designation procedures or the call
for the election.


B. The limitation on the acres which may be irrigated shall continue in effect
until the director makes a final determination pursuant to section 45-414 or the final
results of an election to establish an active management area pursuant to section 45-415
are certified by the board of supervisors of the county or counties in which the proposed
subsequent active management area is located.
