45-572. Modification of conservation program;
notice

A. After a management plan is adopted, the director may modify the plan after
public hearing pursuant to sections 45-570 and 45-571, except that the director may
modify an irrigation water duty or conservation requirement only if the director
determines that extraordinary circumstances, errors or mistakes justify the modification.

B. Within thirty days after a modification of an irrigation water duty or
conservation requirement is adopted, the director shall give written notice of the
modification in the manner and to the persons prescribed in section 45-564, subsection
B. Any aggrieved person may request an administrative review pursuant to section 45-575.

C. All persons notified pursuant to subsection B of this section shall comply with
the modified irrigation water duty or modified conservation requirements not later than
the compliance date specified in the modification notice, unless the person obtains a
variance pursuant to section 45-574.

D. A management plan is deemed to be modified to the extent the director has
established and given written notice of irrigation water duties or conservation
requirements pursuant to section 45-571.01.
