46-303. Violation; injunction


A. No person working in any program supported by state funds nor any state agency
or agency of any political subdivision thereof, or any employee thereof, shall hinder or
prohibit any person who is entitled to eye care which may be rendered by either an
optometrist or a physician and surgeon skilled in diseases of the eye, to select a member
of either such profession to render the service within the scope of his license.


B. Whenever any person has engaged in any act or practice which constitutes a
violation of this section, the superior court in and for the county wherein the act or
practice took place, may issue an injunction, or other appropriate order, restraining
such conduct on application of the attorney general, the county attorney or any person
aggrieved.
