48-1551. Construction of works across private
and public property
A. The board of directors may construct district works across streams of water,
water courses, streets, avenues, highways, railways, canals, ditches, flumes,
transmission lines, telephone or telegraph lines or private property, which the route of
the power line or lines intersect or cross.
B. If the board of directors and the persons owning or controlling any property,
franchise right or other use of property so to be used or crossed, cannot agree on the
amount to be paid for the taking, use or privilege of using such property, the amount
shall be ascertained and determined in the manner provided for taking land for public
uses.
C. The district may locate, construct and maintain the works over, through or upon
any of the lands which are the property of the state, under direction and supervision of
the state land department.
