48-1702. Petition for organization


A. Petition for the formation of an electrical district for the purpose of
providing power for use primarily for pumping water for irrigation shall be filed with
the board of supervisors of the county in which the proposed district is located, or if
parts of the proposed district are located in more than one county, the petition shall be
filed with the board of supervisors of the county in which is located the larger part of
the lands of the proposed district.


B. The petition shall describe an area of land located in one or more counties, and
shall accurately define the exterior boundaries of the parcel or parcels, or otherwise
describe the lands to be included in the proposed district. The area of land to be
organized need not be composed of contiguous tracts. The petition shall pray that the
area of land described be organized into an electrical district under this chapter. The
petition shall be signed by at least one third of the number of resident freeholders
within the area proposed to be organized but no more than twenty-five subscribers to the
petition shall be required in any event.


C. No district shall be organized which includes any territory of a district
already organized or in the process of organization.
