48-1749. Right to use public ways; nature of
use


A. Any district organized under this chapter shall have the use of and the right is
expressly granted to it to use public highways, roads, streets and alleys, within or
without the district, required to bring power into the district, and such use shall
include building transmission lines and laying conduits, pipes or other construction
necessary in conducting the business of the district. The use shall be under reasonable
restrictions set forth by the board of supervisors of the county or governing body of the
city or town in which the public ways are located.


B. Should a controversy over the use arise, the dispute shall be submitted to and
decided by the corporation commission, but the right granted in this section shall be
preserved to the district with necessary limitations only.
