48-2205. Hearing on petition
A. At the hearing all interested property owners and electors may appear and be
heard on any matter relating to the establishment of the proposed district. Before the
date set for the hearing, any person wishing to object to the establishment of the
district may file written objections with the clerk of the board of supervisors.
B. At the hearing the board shall consider the petition and shall hear evidence in
favor of or against the proposal. The board may make any changes in the district
boundaries that it deems advisable. All decisions and determinations made at the hearing
shall be entered in the minutes of the board. If the board approves the establishment of
the district, the minutes shall set forth the particular description of the boundaries of
the district as approved by the board.
C. If the board finds that the territory set out in the petition should not be
incorporated into a health service district, it shall dismiss the proceedings and tax the
costs against the signers of the petition and may collect the cost against the bond or
cash deposit of the petitioners.
