48-2206. Election to determine organization of
district; notice of election; qualifications of voters


A. Notwithstanding the provisions in sections 16-225 and 16-226, the board of
supervisors may order formation of a health service district, the board shall give notice
as prescribed by this section of an election to be held within the proposed district for
the purpose of determining whether the district shall be organized. The board shall set
the date of the election.


B. The notice shall:


1. Designate a name for the proposed district.


2. Describe the boundaries of the district.


3. Designate the polling places to be established within the district for the
election.


4. Be published once a week for at least two consecutive weeks immediately
preceding the election in a newspaper of general circulation in the proposed district.


C. Notwithstanding the provisions in sections 16-225 and 16-226, the election shall
be conducted as nearly as practicable in accordance with the general election laws of
this state. The notice and time periods prescribed by this article apply instead of
title 16, chapter 2, article 3.


D. Election ballots shall contain the words "health service district -- yes" and
"health service district -- no".


E. Eligibility to vote in the election shall be determined by section 16-120.


F. The county recorder or elections director shall be designated the person in
charge of the election and shall supply all election materials, ballots and election
officers.
