48-2613. Contest of election or organization;
appeal
A. The election or organization may be contested by any person owning property
within the proposed district subject to assessment for purposes of the district within
twenty days after canvass of the votes and declaration of the result by the board of
supervisors. The directors elected shall be made parties defendant.
B. The contest shall be brought in the superior court of the county where the
petition for organization is filed, and if more than one contest is pending, they shall
be consolidated for trial. The court shall try the contest without delay and shall
determine whether the election was fairly conducted and in substantial compliance with
the requirements of this article, and enter judgment accordingly.
C. Either party to the record may appeal to the supreme court within thirty days
after entry of judgment. The appeal shall be heard and determined by the supreme court
within sixty days from the time of filing the notice of appeal.
