48-2633. Petition for change of boundaries;
costs
A. The holder or holders of title or evidence of title representing one half or
more of any body of lands adjacent and contiguous to the boundary of a drainage district
which together constitute one parcel of land, may file with the board of directors of the
district a written petition praying that the boundaries of the district be changed to
include such contiguous lands. The petition shall describe the boundaries of the parcel
of land, and also describe the boundaries of the several parcels owned by the
petitioners, if petitioners are the owners, respectively, of distinct parcels, but the
description need not be more particular than is required for lands entered by the county
assessor in the assessment book. The petition shall contain the assent of the
petitioners to the inclusion within the district of the parcels of land described in the
petition, and of which the petitioners allege they are, respectively, the owners. The
petition shall be acknowledged in the same manner as conveyances of land are required to
be acknowledged.
B. The petitioners shall advance to the secretary of the board such amount
necessary to pay the estimated costs arising from or incident to the petition.
