48-2855. Procedure if assessment declared
void


A. If the assessment on a lot, acre or parcel levied for an improvement under this
article, or part of an improvement, or the entire assessment, is adjudged void for any
reason, the board shall levy and assess on the lot, acre or parcel on which the
assessment has been held void, or on all the lots, acres or parcels included within the
limits assessed for the work, a new assessment sufficient to provide for the payment of
the proportionate share of the principal and interest on all district improvement bonds
then unpaid. The reassessment shall be made as nearly as practicable in the same manner
and with the same effect as the original assessment.


B. In case of partial deficit, the board may pay the deficit from the district's
general fund.
