49-1003. Detection of releases; record keeping
requirements
A. Until the rules adopted pursuant to subsection C are in effect, the owner and
operator of an underground storage tank shall maintain a release detection system that
complies with the requirements of 40 Code of Federal Regulations sections 280.40 through
280.44.
B. Until the rules adopted pursuant to subsection C are in effect, the owner and
operator of an underground storage tank shall maintain systematic and complete records of
release detection information that complies with the requirements of 40 Code of Federal
Regulations section 280.45.
C. The director shall adopt rules establishing release detection requirements and
release detection record keeping requirements. The rules adopted pursuant to this
subsection shall be consistent with and no more stringent than the federal regulations in
effect on the date on which the rules are adopted.
