49-747. Annual registration of solid waste
landfills; fee; disposition of revenue


A. All solid waste landfills shall be registered annually with the department.


B. The director shall establish a procedure for mailing registration forms each
year to the owners of all solid waste landfills. The registration is valid for one year
from the date of registration.


C. At the time of registration the owner of a solid waste landfill shall pay to the
department an annual fee for each site registered which is determined according to the
population that the landfill serves based on the following schedule:


1. For solid waste landfills that serve fewer than ten thousand people, five
hundred dollars.


2. For solid waste landfills that serve at least ten thousand people but less than
twenty-five thousand people, seven hundred fifty dollars.


3. For solid waste landfills that serve at least twenty-five thousand people but
less than fifty thousand people, one thousand dollars.


4. For solid waste landfills that serve at least fifty thousand people but less
than one hundred thousand people, two thousand dollars.


5. For solid waste landfills that serve at least one hundred thousand people but
less than two hundred thousand people, three thousand dollars.


6. For solid waste landfills that serve two hundred thousand people or more, five
thousand dollars.


7. Solid waste landfills that are open to the public and that accept demolition
waste shall pay a flat fee of one thousand five hundred dollars.


8. Solid waste landfills that are closed to the public and that accept
nonhazardous waste shall pay a flat fee of one thousand five hundred dollars.


D. All monies collected pursuant to this section shall be deposited in the solid
waste fee fund established by section 49-881. The director may authorize the expenditure
of monies from the solid waste fee fund to pay the reasonable and necessary costs of
administering the registration program pursuant to section 49-881.
