9-302. Bonds of officers


A. Unless bonded pursuant to the provisions of subsection B of this section, every
officer of a city or town shall execute and file an official bond, enforceable against
the principal and his sureties, conditioned on the due and faithful performance of his
official duties, payable to the state and to and for the use and benefit of the
municipality or any person who may be injured or aggrieved by the wrongful act or default
of the officer in his official capacity. A person injured or aggrieved may bring suit on
such bond under the provisions of section 38-260.


B. Any incorporated city or town may obtain and deliver to the city or town clerk a
blanket bond conditioned on faithful performance of all such city's or town's officers
payable to the municipality, except the treasurer or tax collector by whatever title
known, who shall execute the official bond provided for in subsection A.
