Denial of application, grounds--review.

197.262. 1. The department may deny any hospiceapplication for certification or renewal or may suspend or revokesuch agency's certificate or invoke intermediate sanctions, ifthe hospice:

(1) Is out of compliance with any of the provisions ofsections 197.250 to 197.280 and the rules made pursuant thereto;or

(2) Obtained its certificate through misrepresentation of,or concealment of, any fact.

2. Any hospice may seek a review of any denial, suspension,or revocation of its certification or renewal before theadministrative hearing commission, as provided in chapter 621,RSMo.
