Receivers, duties of--notes not taken by delivery bond--maysue--defenses not impaired.

521.310. When notes, bills, books of account, accounts orother evidences of debt are attached, they shall not be subjectto be retained upon the execution of a delivery bond, as hereinprovided, but shall be delivered to the receiver, who shallproceed with diligence to settle and collect the same. For thatpurpose he may commence and maintain actions on the same, in hisown name; but in such actions no right of defense shall beimpaired.
