532.500. If a prisoner be not entitled to his discharge, andbe not bailed, the court before whom the proceedings are hadshall remand him to the custody or place him under the restraintfrom which he was taken, if the person under whose custody orrestraint he was, be entitled thereto; if not so entitled, thenhe shall be committed to the custody of such officer or person asby law is entitled thereto.
