540.170. It shall be the duty of the circuit clerk to issuesubpoenas for witnesses to be and appear before the grand jury ofthe circuit court thereafter, at the instance of the prosecutingor circuit attorney, whenever it shall be shown that suchwitnesses are about to absent themselves to avoid beingsubpoenaed before the grand jury.
