§ 131E‑303. Incurred but not reported claims.

(a)        Every PSO shall, when determining liability, include anamount estimated in the aggregate to provide for any unearned premium and forthe payment of all claims for health care expenditures that have been incurred,whether reported or unreported, that are unpaid and for which such PSO is ormay be liable, and to provide for the expense of adjustment or settlement ofsuch claims.

(b)        These liabilities shall be computed in accordance with rulesadopted by the Division upon reasonable consideration of the ascertainedexperience and character of the PSO. (1998‑227, s. 1.)
