30-687. Routine enforcement action; civil penalty

A. A person who violates this chapter or any rule or regulation of the agency or any license requirement is subject to a civil penalty imposed by the agency. The agency shall issue a notice of violation to the violator and may hold a hearing prior to assessment of a civil penalty. The agency may in lieu of imposing a civil penalty prescribe a time for elimination of the violation and assessment of a civil penalty if the violation is not eliminated within the time prescribed by the order. The attorney general shall bring actions to collect a civil penalty assessed under this subsection.

B. The agency shall, by rule and regulation, establish a schedule of civil penalties based on factors such as the nature of the violation, the number of previous violations and whether the violation was of a serious nature.

C. The agency may impose a civil penalty of not more than five thousand dollars for each violation for each day up to a maximum of twenty-five thousand dollars for any thirty day period.

D. A final order of the agency under this section is subject to appeal to the radiation regulatory hearing board.
