STREETS AND HIGHWAYS CODE
SECTION 5194-5198



5194.  The legislative body shall appoint the time and place of the
hearing on the resolution of intention and shall cause notice of that
hearing and the public meeting required by Section 54954.6 of the
Government Code to be mailed as provided in subdivision (c) of that
section.


5196.  If the doing of the work requires a change of grade of any
railroad track or tracks, the legislative body shall direct the clerk
to mail to the owner or reputed owner or operator or reputed
operator thereof, at its last known address as the same appears on
the tax rolls of the city, the legislative body of which is
conducting the proceeding, or when no address so appears then to such
owner or operator in care of general delivery in such city and to
the Public Utilities Commission, printed copies of the resolution of
intention within five days after the first publication thereof.
Failure to mail said copies or failure of any such owner or operator
to receive the same or any erroneous address thereon shall not affect
the jurisdiction of the legislative body, but in such event the
failure of the owner or operator of such tracks to make objection to
the proposed grades shall not be deemed to be a waiver of all
objections to the proposed grades or proposed change or modification
of grade, nor operate as a bar to any claim for damages, if
recoverable damages there be.



5198.  This chapter shall not apply if the hearing of objections is
not required pursuant to Section 5132.
