ยง9-3ย Duties.ย The foundation shall:
(1)ย Assist in coordinating the plans, programs, andactivities of individuals, associations, corporations, and agencies concernedwith the preservation and furtherance of culture and the arts and history andthe humanities;
(2)ย Establish written standards and criteria by whichgrant contracts shall be evaluated;
(3)ย Appraise the availability, adequacy, andaccessibility of culture and the arts and history and the humanities to allpersons throughout the State and devise programs whereby culture and the artsand history and the humanities can be brought to those who would otherwise nothave the opportunity to participate;
(4)ย Stimulate, guide, and promote culture and thearts and history and the humanities throughout the State;
(5)ย Devise and recommend legislative andadministrative action for the preservation and furtherance of culture and thearts and history and the humanities;
(6)ย Study the availability of private andgovernmental grants for the promotion and furtherance of culture and the artsand history and the humanities;
(7)ย Through its executive director:
(A)ย Administer funds allocated by grant, gift,or bequest to the foundation; accept, hold, disburse, and allocate funds thatmay become available from other governmental and private sources; provided thatall those funds shall be disbursed or allocated in compliance with any specificdesignation stated by the donor and in the absence of any designation, thefunds shall be disbursed or allocated for the promotion and furtherance ofculture and the arts and history and the humanities; and
(B)ย Accept, hold, disburse, and allocatepublic funds that are made available to the foundation by the legislature fordisbursement or allocation, pursuant to the standards and proceduresestablished in part II, for the promotion and furtherance of culture and thearts and history and the humanities;
(8)ย Submit an annual report with recommendations tothe governor and legislature, prior to February 1, of each year.ย Annualreports shall include the total number and amount of gifts and other grants andincome received, payroll disbursements, contracts entered into, and progressand accomplishments made during the year, including the efforts of the Hawaiiarts education partners and its progress in implementing the Hawaii artseducation strategic plan and the accomplishments of the art in public placesand relocatable works of art programs and the state art museum;
(9)ย Convene the Hawaii arts education partners, whichis composed of the department of education, the colleges of education and artsand humanities of the University of Hawaii at Manoa, the Hawaii Association ofIndependent Schools, and the Hawaii Alliance for Art Education, to fullyimplement the terms of the Hawaii arts education strategic plan;
(10)ย Display student art works in public buildings,sponsor student art displays, promote arts education, and in other waysencourage the development of creative talent among the young people of Hawaii;
(11)ย In cooperation with qualified organizations,conduct research, studies, and investigations in the fields of ethnohistory andthe humanities:
(A)ย Make, publish, and distribute worksdocumenting the contributions of individual ethnic groups in their relationshipto one another and to the whole population of Hawaii;
(B)ย Place ethnohistorical and culturalmaterials developed by the foundation or received by the foundation as giftsand donations in public archives, libraries, and other suitable institutionsaccessible to the public; and
(C)ย Maintain a register of the locationof such materials;
(12)ย Cooperate with and assist the department of landand natural resources and other state agencies in developing and implementingprograms relating to historic preservation, research, restoration, andpresentation, as well as museum activities;
(13)ย Establish an individual artist fellowship programto encourage artists to remain and work in Hawaii and to reaffirm theimportance of Hawaii's artists and their cultural and economic contributions tothe State by:
(A)ย Recognizing and honoring Hawaii'sexceptionally talented visual and performing artists for their outstanding workin and commitment to the arts; and
(B)ย Enabling these artists to further theirartistic goals;
(14)ย In consultation with the comptroller andaffected agencies and departments, administer the art in public places andrelocatable works of art programs established pursuant to section 103-8.5; and
