ยง11-1.6ย Appointment of the chief electionofficer; requirements; term; restrictions; salary; reappointment; removal.ย (a)ย The chief election officer shall be appointed by the elections commission,without regard to chapter 76.ย The appointment shall not be subject to theadvice and consent of the senate.ย In the event of a vacancy, the electionscommission shall meet expeditiously to select and appoint a new chief electionofficer to serve the remainder of the unexpired term.
(b)ย The person appointed to be chief electionofficer shall be a citizen of the United States, a resident of the State, and aregistered voter of the State.
(c)ย The chief election officer shall serve fora term of four years.ย The term shall begin on February 1 following the appointment.
(d)ย The chief election officer shall devotefull time to the duties of the office and shall hold no other public officeduring the individual's term of office.ย Except for exercising the right tovote, the individual shall not support, advocate, or aid in the election ordefeat of any candidate for public office.ย The chief election officer shallrefrain from financial and business dealings that tend to reflect adversely onthe individual's impartiality, interfere with the proper performance of electionduties, or exploit the individual's position.ย Subject to the requirementsabove, the individual may hold and manage investments, including real estate,and engage in other remunerative activity, but shall not serve as an officer,director, manager, advisor, or employee of any business.
(e)ย The chief election officer shall be paid asalary not to exceed eighty-seven per cent of the salary of the director ofhuman resources development.
(f)ย The chief election officer may petitionthe elections commission for reappointment.ย The elections commission mayreappoint an incumbent chief election officer based on the performance of thechief election officer.ย The elections commission may authorize the chiefelection officer to hold office until a successor is appointed.
