§11-206  Campaign contributions;restrictions as to surplus.  (a)  Every candidate in a primary, specialprimary, special, or general election who has voluntarily agreed to abide byspending limits and who subsequently receives campaign contributions in anamount greater than the expenditure limit set for the candidate's respectiveoffice shall reserve use of these contributions until after a general orspecial election.

(b)  Campaign contributions shall not be usedfor personal expenses or to qualify for public funding in any subsequentelection, and shall not be transferred to another candidate as prohibited insection 11-200.

Where such contributions are used for thepurchase or lease of consumer goods, vehicles, equipment, and services thatprovide a mixed benefit to the candidate, they shall be reported to thecommission pursuant to sections 11-212 and 11-213.

(c)  Surplus funds may be used after a generalor special election for:

(1)  Any fundraising activity;

(2)  Any other politically related activity sponsoredby the candidate;

(3)  Any ordinary and necessary expenses incurred inconnection with the candidate's duties as a holder of an elected state orcounty office; or

(4)  Any contribution to any community service, educational,youth, recreational, charitable, scientific, or literary organization; providedthat in any election cycle, the total amount of all contributions from surplusfunds shall be no more than twice the maximum amount that one person or otherentity may contribute to that candidate pursuant to section 11-204(a); providedfurther that no contributions from campaign funds shall be made from the datethe candidate files nomination papers to the date of the general election.
