§11-214 - Disposition of funds.
§11-214 Disposition of funds. (a) Candidates, committees, and individuals who receive contributions for anelection but fail to file a nomination for that election shall return allresidual funds to the donors no later than ninety days after the date on whichnominations for that election must be filed. Contributions not returned to thedonors shall escheat to the Hawaii election campaign fund.
(b) Candidates, committees, and individualswho withdraw or cease to be candidates or committees because of death, termlimits, disqualification, resignation, or other personal reasons shall returnall residual funds to the donors no later than ninety days after the candidateor committee ceases to be a candidate or committee. Residual funds notreturned to the donors shall escheat to the Hawaii election campaign fund. Contributions shall only be used for expenditures directly related to thecandidate's or committee's activities to influence the outcome of the electionor nomination for election.
(c) Candidates, and the committees of acandidate who:
(1) Are elected to office, may expend surplus fundspursuant to section 11-206, but under no circumstances shall expenditures bemade from funds after four years from the date of the election for which thecontributions were received; or
(2) Fail to be nominated or elected to office, mayexpend surplus funds pursuant to section 11-206 but under no circumstancesshall expenditures be made from funds after one year from the date of theelection for which the contributions were received.
Contributions not returned to the donors shallescheat to the Hawaii election campaign fund.
(d) Surplus funds may be expended by acandidate for the next subsequent election upon registration for the electionpursuant to section 11-194.
(e) Candidates or committees that dispose offunds pursuant to this section shall terminate registration with the commissionas provided in section 11-213.
