§11-217.5  Depletion of fund.  (a)  TheHawaii election campaign fund shall be under no obligation to provide moneys toeligible candidates if, in the partial public funding program or comprehensivepublic funding for elections to the county of Hawaii council, moneys in thatfund are near depletion.

(b)  For purposes of the partial fundingprogram, if the Hawaii election campaign fund is close to depletion, asdetermined by the commission, the commission shall determine the amountsavailable to eligible candidates based on their order of eligibility inqualifying for partial public funds, as determined by the date of filing of anapplication for public funds with the commission pursuant to section 11-222;provided that the application has been accepted by the commission.

(c)  For the purposes of the comprehensivepublic funding for elections to the county councils, if the Hawaii electioncampaign fund is close to depletion, the commission shall determine whetherthat program shall be operative in accordance with subpart .
