Designation of additional areas. 
Designation of additional areas to be common elements or subject to common
expenses after the initial filing of the bylaws or declaration shall require
the approval of ninety per cent of the apartment owners; provided that if the
developer discloses to the initial buyer in writing that additional areas will
be designated as common elements pursuant to an incremental or phased project,
this requirement shall not apply as to those additional areas. [L 2007, c 244,
