[§667-25]  Date, place of public sale of
mortgaged property.  (a)  The public sale of the mortgaged property shall
take place on the later of the following:



(1)  At least sixty days after the public notice of
the public sale is distributed under section 667-27; or



(2)  At least fourteen days after the date of the
publication of the third public notice advertisement under section 667-27.



(b)  The public sale of the mortgaged property
shall be held in the county where the mortgaged property is located.  However,
if the borrower, the mortgagor, and the foreclosing mortgagee all agree in
writing, the public sale may be held in a different county in the State.  The
public sale shall be held during business hours on a business day.



(c)  The public sale of the mortgaged property
shall be conducted by the foreclosing mortgagee on the date, at the time, and
at the place described in the public notice of the public sale. [L 1998, c 122,
