§48E-4  Conditions precedent.  Thecounty shall not undertake any pollution control project or enter into anyproject agreement with respect thereto unless the governing body shall firstfind and determine either:

(1)  That the proposed project party is a responsibleparty, whether by reason of economic assets, experience in the type ofenterprise to be undertaken through the pollution control project, orotherwise, or

(2)  That the obligations of the project party underthe project agreement will be unconditionally guaranteed or insured by, or thatthe performance thereof is assigned to, or guaranteed or insured by, a personwho is a responsible party, whether by reason of economic assets, experience inthe type of enterprise to be undertaken through the pollution control project,or otherwise.
