§88-158  Disability retirement benefits. Whenever any member of the police force, fire department, or band of any countyshall, on examination by the medical board provided for in section 88-155, befound to be disabled physically or mentally because of any injury received ordisease contracted while in the performance of the member's duty so as torender necessary the member's retirement from the service on the police force,fire department, or band of the county, then the board of trustees shall authorizea monthly payment to the person from the pension system of a sum equal to notless than one-quarter nor more than three-quarters of the person's averagemonthly compensation for the ten years (or less, if the person has had lessthan ten years) of the person's service, as defined in section 88-166,immediately preceding the person's adjudication of disability by the medicalboard.
