§103D-110  Education and training.  (a) The department of human resources development, either alone or in cooperationwith any governmental body, including the department of labor and industrialrelations, or in cooperation with other states, the federal government, orother persons may:

(1)  Conduct or participate in procurement educationand training for persons not employed by the State; and

(2)  Sponsor a purchasing certification programconducted by a voluntary organization of procurement professionals.

(b)  The state procurement office, incooperation with the department of human resources development, shall developand maintain a procurement practices training and development program forprocurement officers of the State and the several counties, to ensure that anagency's procurement practices are in compliance with the procurement code andthat proper procurement decisions are made consistent with this chapter.  Theprogram shall include a mandatory fundamental training and development sessionand follow-up training and development sessions.

(c)  Each state procurement officer of adepartment of the executive branch shall attend a mandatory fundamentaltraining and development session within sixty days of being appointed or namedto the position of procurement officer.

(d)  Each state procurement officer of adepartment of the executive branch whom the state procurement office determinesis in need of further training and development based upon:

(1)  The history of procurement compliance to this chapterby the agency to which the particular procurement officer is attached; or

(2)  Any other need for training and development,

shall attend follow-up training and developmentsessions.

(e)  Attendance by state procurement officersat the follow-up training and development sessions, other than as requiredunder subsection (d), and by county procurement officials at the fundamentaland follow-up training and development sessions is optional, though encouraged.[L Sp 1993, c 8, pt of §2; am L 1994, c 56, §§1, 22; am L 2008, c 194, §1]
