ยง103D-407ย  Construction projects, roadwaymaterials; recycled glass content requirements.ย  (a)ย  When purchasingroadway materials or other high-value, end-use applications for publicprojects, state agencies shall, and county agencies may, purchase materialswith minimum recycled glass content meeting specifications adopted by thepolicy board which, at a minimum, shall provide for:

(1)ย  A minimum recycled glass content of ten per centcrushed aggregate in treated or untreated basecourse in paving materials thatshall not reduce the quality standards for highway and road construction; and

(2)ย  The use of one hundred per cent aggregate innonstructural capital improvement applications.

(b)ย  All highway and road construction andimprovement projects funded by the State or a county or roadways that are to beaccepted by the State or a county as public roads shall utilize a minimum often per cent crushed glass aggregate as specified by the department oftransportation in all basecourse (treated or untreated) and subbase when theglass is available to the quarry or contractor at a price no greater than thatof the equivalent aggregate.

(c)ย  All state and county construction projectscalling for nonstructural backfill shall utilize one hundred per cent crushed glasswhen available at a cost equal to or lower than the equivalent aggregate.

(d)ย  As used in this section:

"Basecourse" means the layer orlayers of specified material or selected material of a designed thickness tosupport a surface course.

"Environmental management specialfund" means the fund established by section 342G-63.

"Nonstructural backfill" means use asfill in areas not subject to structural loading, including but not limited toutility line bedding, drainage backfill behind retaining walls, drainage linebackfill in leachfields or french drains, and similar uses.
