§121-13 Commissioned by commander in chief. All commissioned officers of the army or air national guard shall becommissioned by the commander in chief but the commander in chief may refuse toissue a commission to any person, if in the commander in chief's opinion, theperson is in any way unqualified or unworthy to be an officer. All commissionsin the military service of this State shall be in the name and by authority ofthe State, sealed with the state seal, signed by the governor, attested by the adjutantgeneral, and recorded in rosters periodically prepared and printed by thedepartment of defense.
