PART I. GENERAL PROVISIONS

 

[§124A-1]  Definitions.  In thischapter, unless the context otherwise requires:

"Accuser" means a person who signsand swears to charges, any person who directs that charges nominally be signedand sworn to by another, and any person who has an interest other than anofficial interest in the prosecution of the accused.

"Active state duty" means duty in theactive military service of the State under an order of the governor issuedunder authority vested in the governor by law, and includes travel to and fromsuch duty.

"Adjutant general" means the adjutantgeneral of the State as defined in section 121-7.

"Commanding officer" includes onlycommissioned officers.

"Commissioned officer" includes acommissioned warrant officer.

"Convening authority" includes, inaddition to the person who convened the court, a commissioned officercommanding for the time being, or a successor in command.

"Duty status other than active stateduty" means any time when members and units of the state military forcesassemble for drill or other equivalent training, instruction, or duty orparticipate in field training, encampments, maneuvers, schools, conferences,cruises, or other similar duties as may be prescribed by the laws of the UnitedStates (including but not limited to title 32 of the United States Code) or ofthe State and any regulations issued thereunder, and includes travel to andfrom such duty.

"Enlisted member" means a person inan enlisted grade.

"Governor" means the governor of theState.

"Grade" means a step or degree, in agraduated scale of office or military rank, that is established and designatedas a grade by law or regulation.

"Law officer" means an official of ageneral court-martial detailed in accordance with section 124A-45.

"Law specialist" means a commissionedofficer of the organized militia of the State designated for special duty.

"Legal officer" means anycommissioned officer of the organized militia of the State designated toperform legal duties for a command.

"Military" refers to any or all ofthe armed forces.

"Military court" means acourt-martial, a court of inquiry, or a provost court.

"Officer" means commissioned orwarrant officer.

"Rank" means the order of precedenceamong members of the state military forces.

"State judge advocate" means thecommissioned officer responsible for supervising the administration of themilitary justice in the state military forces.

"State military forces" means thenational guard of the State, as defined in section 101(3) of title 32, UnitedStates Code, the organized naval militia of the State, and any other militaryforce organized under the laws of the State.

"Superior commissioned officer" meansa commissioned officer superior in rank or command. [L 1982, c 171, pt of §2;gen ch 1985]
