[§124A-117]  Solicitation.  (a)  Anyperson subject to this chapter who solicits or advises another or others todesert in violation of section 124A-120 or mutiny in violation of section124A-129 shall, if the offense solicited or advised is attempted or committed,be punished with the punishment provided for the commission of the offense,but, if the offense solicited or advised is not committed or attempted, theperson shall be punished as a court-martial may direct.

(b)  Any person subject to this chapter whosolicits or advises another or others to commit an act of misbehavior beforethe enemy in violation of section 124A-134 or sedition in violation of section124A-129 shall, if the offense solicited or advised is committed, be punishedwith the punishment provided for the commission of the offense, but, if theoffense solicited or advised is not committed, the person shall be punished asa court-martial may direct.
