§124A-98 - Error of law; lesser included offense.

[§124A-98]  Error of law; lesser includedoffense.  (a)  A finding or sentence of a court-martial may not be heldincorrect on the ground of an error of law unless the error materiallyprejudices the substantial rights of the accused.

(b)  Any reviewing authority with the power toapprove or affirm a finding of guilty may approve or affirm so much of thefinding as includes a lesser included offense. [L 1982, c 171, pt of §2]
