§138-3  Wireless enhanced 911 fund. There is established outside the state treasury a special fund, to be known asthe wireless enhanced 911 fund, to be administered by the board.  The fundshall consist of amounts collected under section 138-4.  The board shall placethe funds in an interest-bearing account at any federally insured financialinstitution, separate and apart from the general fund of the State.  Moneys inthe fund shall be expended exclusively by the board for the purposes ofensuring adequate cost recovery for the deployment of phase I and phase IIwireless enhanced 911 service and for expenses of administering the fund.  Anyfunds that accumulate in the wireless enhanced 911 fund shall be retained inthe fund unless determined by the legislature to be in excess.
