§142-3.5  Authority to contract orrent facilities.  The board of agriculture may contract with third partiesfor the use or rental of animal quarantine property or facilities; providedthat:

(1)  The board determines the property or facilitiesare not required for use by the animal quarantine program during the term ofuse by the third party;

(2)  The property or facilities shall be leased orrented at a reasonable lease rent as determined by the board of agriculture;

(3)  The property or facilities shall be used foranimal welfare, including emergency shelters for animals, oragriculture-related purposes; and

(4)  The property or facilities shall be used only bythe third party.

Revenues generated by the use or rental of theanimal quarantine property or facilities shall be used to defray theoperational costs of the animal quarantine program and to minimize animalquarantine fees. [L 2005, c 161, §2; am L 2008, c 109, §1]
