ยง159-37ย Records; subject to examination.ย
(a)ย For the enforcement of this chapter, the following classes of persons
shall keep records as the board may prescribe and all persons subject to the
requirements shall, at all reasonable times, upon notice by a duly authorized
representative of the board, afford the representative or any duly authorized
representative of the Secretary of Agriculture access to their places of
business and opportunity to examine the facilities, inventory, and records
thereof, to copy all of those records, and to take reasonable samples of their
inventory upon payment of the fair market value therefor:
(1)ย Any person who engages, in or for intrastate
commerce, in the business of slaughtering any cattle, sheep, swine, goats,
horses, mules, or other equines, or preparing, freezing, packaging, or labeling
any carcasses, or parts or products of carcasses, of any animals, for use as
human food or animal food.
(2)ย Any person who engages in the business of buying
or selling as meat broker, wholesaler or otherwise, or transporting in
intrastate commerce, or storing in or for commerce, any carcasses, or parts or
products of carcasses, of any animals.
(3)ย Any person who engages in business, in or for
intrastate commerce, as a renderer, or engages in the business of buying,
selling, or transporting, in commerce, any dead, dying, disabled, or diseased
cattle, sheep, swine, goats, horses, mules, or other equines, or parts of the
carcasses of the animals that died otherwise than by slaughter.
(4)ย Any person who engages in the business of custom
slaughtering or preparing any cattle, sheep, swine, goats, horses, or other
equines for use as human food or animal food.
(b)ย Any record required to be maintained by
this section shall be maintained for the period of time as the board may
