ยง198D-2ย Establishment of Hawaii statewidetrail and access program.ย (a)ย There is established the Hawaii statewidetrail and access program, to be known as Na Ala Hele.ย The department of landand natural resources shall plan, develop, acquire land or rights for publicuse of land, construct, restore, and engage in coordination activities toimplement the program in accordance with this chapter.
(b)ย The trail and access program shall usefunding for the management, maintenance, and development of trails and trailaccesses under the jurisdiction of the department from the following sources:
(1)ย A portion of the highway fuel taxes collectedunder chapter 243;
(2)ย Federal government grants;
(3)ย Private contributions;
(4)ย Fees, established pursuant to administrativerules and charged by the department for the commercial and other use of trailsand trail accesses under the jurisdiction of the department; and
(5)ย Transient accommodations tax revenues pursuant tosection 237D-6.5.
(c)ย The moneys specified in subsection (b)(2)shall be deposited in the state treasury; provided that moneys received asdeposits or contributions from the federal government shall be accounted for inaccordance with the conditions established by the agencies making the contribution.
(d)ย The moneys specified in subsection (b)(1),(3), (4), and (5) shall be deposited in the special land and development fundunder section 171-19 for the management, maintenance, and development of trailsand trail accesses under the jurisdiction of the department; provided that themoneys specified in subsection (b)(5) shall be expended for the management,maintenance, and development of trails and access areas frequented by visitorsin response to a master plan developed in coordination with the Hawaii tourismauthority.
