[§201H-52]  Nonprofit organizations andgovernment agencies.  (a)  The corporation may retain dwelling units in aproject to the extent it determines necessary and appropriate, for sale, lease,or rental to nonprofit organizations and government agencies.  The dwellingunits shall be used by the nonprofit organizations and government agencies toprovide housing opportunities and related support services to special needsindividuals or families.  These purposes include but are not limited to the useof dwelling units for group homes and congregate living facilities and forgovernment employees in special situations.  The corporation, in consultationwith other appropriate government agencies, shall adopt rules pursuant tochapter 91 necessary to implement this subsection, including but not limited torules relating to the eligibility and qualifications of nonprofit organizationsand government agencies; the eligibility and qualifications of clients ofnonprofit organizations and government agencies to whom housing opportunitiesmay be made available; and restrictions on the use, sale, or transfer of, andauthorizing repurchase of, dwelling units sold, leased, or rented pursuant tothis subsection.

The corporation, to the extent appropriate,shall have the same powers with respect to nonprofit organizations andgovernment agencies purchasing, leasing, or renting dwelling units as thecorporation has with respect to qualified residents purchasing, leasing, orrenting dwelling units.

(b)  In connection with the development of anyresidential units under this chapter, the corporation may provide for thedevelopment of appropriate community facilities. The corporation may:

(1)  Sell, lease, or rent vacant land or land withsite improvements to nonprofit organizations or government agencies to developcommunity facilities; or

(2)  Develop, on behalf of the State or with aneligible developer, the community facilities and then sell, lease, rent, orotherwise transfer or make available these facilities to nonprofit organizationsor government agencies.

The corporation shall adopt rules pursuant tochapter 91 necessary to implement this subsection. [L 2006, c 180, pt of §3]
