§206J-6 Limitations on the powers of thedevelopment corporation. (a) The development corporation shall not sellany fast or submerged lands of the Aloha Tower complex as established by thischapter.
(b) The development corporation shall preservethe Aloha Tower as an historical monument and shall not sell, remove, demolish,deface, or alter the structure in any reasonable degree to lessen itshistorical value to the community. However, and notwithstanding any other lawto the contrary, repairs, maintenance, relocation of pier platforms, or anyessential reconstruction necessary for the preservation of the Aloha Tower asan historical monument shall be permissible.
(c) Irwin Memorial Park shall be retained as apublic park subject to the reservations and conditions set forth in the deed ofHelene Irwin Fagan to the Territory of Hawaii.
(d) The development corporation or its lesseesshall not exercise any jurisdiction over the provided replacement facilitieslocated within the Aloha Tower complex required for necessary maritime purposesand activities (hereinafter "maritime facilities"). Jurisdictionover any such replacement facilities shall be in the department oftransportation. Facilities functionally related to maritime purposes and thepurposes outlined in the development plan for the Aloha Tower complex, such ashotel facilities for maritime passengers and waterfront visitors, concessionfacilities adjacent to maritime terminal facilities, public parking facilitieswhich are situated on property not currently under the jurisdiction of thedepartment of transportation, and commercial, retail, residential, and officefacilities may be under the jurisdiction of the development corporation or itslessees.
