§261-1  Definitions.  As used in thischapter:

"Aeronautics" means the science andart of flight, including but not limited to transportation by aircraft; theoperation, construction, repair, or maintenance of aircraft, aircraft powerplants and accessories, including the repair, packing, and maintenance ofparachutes; the design, establishment, construction, extension, operation,improvement, repair, or maintenance of airports, or other air navigationfacilities; and instruction in flying or ground subjects pertaining thereto.

"Aircraft" means any contrivance nowknown or hereafter invented, used or designed for navigation of or flight inthe air.

"Airman" means any individual who engages,as the person in command, or as pilot, mechanic, or member of the crew, in thenavigation of aircraft while under way, and any individual who is directly incharge of the inspection, maintenance, overhauling, or repair of aircraftengines, airframes, propellers, or appliances; and any individual who serves inthe capacity of aircraft dispatcher, or air-traffic control-tower operator; butdoes not include any individual employed outside the United States, and itsterritories and possessions, or any individual employed by a manufacturer ofaircraft, aircraft engines, propellers, or appliances to perform duties asinspector or mechanic in connection therewith, or any individual performinginspection or mechanical duties in connection with aircraft owned or operatedby the individual.

"Air navigation facility" means anyfacility used in, available for use in, or designed for use in, aid of airnavigation, including any structures, mechanisms, light, beacons, markers,communicating systems, or other instrumentalities, or devices used or useful asan aid, or constituting an advantage or convenience, to the safe taking-off,navigation, and landing of aircraft, or the safe and efficient operation ormaintenance of an airport, and any combination of any or all of suchfacilities.

"Airport" means any area of land orwater which is used, or intended for use, for the landing and takeoff ofaircraft, and any appurtenant areas which are used, or intended for use, forairport buildings or other airport facilities or rights-of-way, includingapproaches, together with all airport buildings and facilities located thereon.

"Airport hazard" has the meaningdefined by section 262-1.

"Criminal history record check" meansan examination of an individual's criminal history records by means including,but not limited to, fingerprint analysis and name inquiry into state andnational criminal history record files.

"Criminal history record information"means criminal history information received from state and national criminal historyrecord checks.

"Department" means the department oftransportation.

"Director" means the director oftransportation.

"Municipal" means pertaining to amunicipality as herein defined.

"Municipality" means any county orother political subdivision or public corporation of the State.

"Operation of aircraft" or"operate aircraft" means the use, navigation, or piloting of aircraftin the airspace over the State or upon any airport within the State.

"Person" means any individual, firm,partnership, corporation, company, association, joint stock association, orbody politic; and includes any trustee, receiver, assignee, or other similarrepresentative thereof.

"Police officer" means a policeofficer and any other state or county officer charged with the enforcement ofstate laws.

"State airway" means a route in thenavigable airspace over and above the lands or waters of the State, designatedby the department as a route suitable for air navigation.
